Description
The Allegheny County Health Department is seeking to engage several licensed Pennsylvania attorneys to provide hearing officer services on a contract basis regarding all appeals that are taken from any final agency action of the Allegheny County Health Department, including but not limited to, enforcement actions, denials of variances, and permit appeals.
Hearings:
- Generally, a ½ to a full-day hearing for Food/Housing/Plumbing matters.
- One to five days for hearings related to air quality matters.
Drafting of opinions:
- For less involved cases - 1-2 days
- For more complex Air Quality matters – 3 days to a week
Responsibilities would include:
- Scheduling of hearings, coordination with stenographer to attend and transcribe hearings.
- Issue any necessary orders on Case Management, Discovery, Briefing Schedules , etc.
- Conduct hearings.
- Obtain copies of the transcripts.
- Issue findings of fact and conclusions of law.
- Candidates should be familiar with the Local Heath Administration Law 16 P.S. §12001, et seq.
- Candidates should be familiar with Article XI of the Rules and Regulations pertaining to Hearings and Appeals as promulgated by the Allegheny County Health Department. Microsoft Word - Article XI (FINAL Draft)
- Other responsibilities as necessary to carry out the above-listed duties.
Other:
- Ideally, be willing to conduct an average of 3-4 hearings per month that vary in complexity.
- Prior administrative law experience preferred.
- This is 1099 contract position compensated on an hourly basis at the rate $150.00 per hour.
- Unless the matter is exceedingly complex or involves an air quality matter, the fee would be capped at $7,200.00, however, this cap can be adjusted based upon actual time needed to adjudicate a matter.
